Keyser Marston has assisted over 25 cities and counties with their inclusionary housing programs. Keyser Marston services range from limited tasks such as analyses that support in lieu fees to the full design of a new inclusionary program with all of its ordinance and implementation provisions.

Keyser Marston employs its real estate expertise to adapt new or revised programs to local market conditions and policy objectives. Keyser Marston avoids the “one size fits all” approach and works with communities to sort out priorities and respond to local concerns, needs and agendas.

Keyser Marston has analyzed inclusionary programs that have been in operation for 30 years and learned from the issues that emerge in the long-term administration of an inventory of rental and ownership units. As a result, Keyser Marston offers extensive expertise with deed restriction provisions and the many administrative procedural aspects of an inclusionary program.

  • Analysis of local residential development projects and the impact of alternative inclusionary requirements to identify suitable requirements for the market conditions and policy objectives
  • Analysis of inclusionary requirements and in lieu fee equivalent alternatives
  • Analysis of off-site compliance options, including off-site development and land dedication, and assistance with specific provisions and criteria for ordinance language
  • Analysis of density bonus law application to local programs and the extent to which it can offset local inclusionary requirements
  • Recommendations for deed restriction provisions such as resale pricing formulas, capital improvement provisions, noticing and foreclosure procedures and rights, and other aspects of long-term ownership
  • Experience in meeting with stakeholder groups such as developers, housing advocates and nonprofit developers, combined with the ability to “speak the language” with developers and listen to their concerns and requests
  • Experience in making presentations to housing commissions, planning commissions and city councils, addressing concerns about the impact of the program on local development activity
